1. The Standardised Rental Application Process
In Victoria, property managers and rental providers must use the official prescribed application form - or an approved digital equivalent that aligns with Consumer Affairs Victoria (CAV) standards.
This standardised approach ensures every candidate is assessed on an equal, transparent footing, protecting renters from invasive or non-standard questions while giving rental providers the clear, necessary information to make an informed decision.
2. Information Requests: What Can (and Cannot) Be Asked
To keep the leasing process fair and secure, clear boundaries dictate what information property managers are permitted to collect during the application phase.
What Information Can Be Requested?
To process an application, property managers typically ask for:
- Basic Personal Details: Full name, date of birth, contact details, and current residential address.
- Employment & Income Verification: Details of your current or most recent employment. If you are self-employed, casual, or between roles, alternative proof showing your capacity to pay rent (such as proof of savings or assets) can be provided.
- Financial Documentation: Up to two documents from an approved list, such as recent payslips, bank statements showing balance only (without transaction details), or Centrelink statements.
- Identity Verification: Up to two standard identity documents as requested by the agent/owner, (such as a Driver Licence, Passport, Medicare card, or utilities bill in your name).
- Rental History & References: Details of your past residential addresses, rental providers, and personal referees.
- Lease Terms: Your preferred lease duration (e.g., 6, 12, or 24 months) and target move-in date.
What Information Is Strictly Off-Limits?
To protect your privacy and uphold equal opportunity laws, a rental provider or agent cannot ask for:
- Daily bank statements displaying your individual transaction history (you are entitled to redact non-essential private details).
- Your bond history or past bond claim records.
- Information regarding past legal disputes or tribunal proceedings with previous landlords.
- Details relating to protected personal attributes (such as age, gender identity, ethnicity, disability, or religion) under the Equal Opportunity Act 2010, unless a valid, legally required explanation is provided to you in writing.
Discrimination Protections
It is illegal to decline an application based on protected personal characteristics. Furthermore, rental providers generally cannot refuse an applicant simply because they have children under 16, unless the property is the provider's main residence or its physical design makes it genuinely unsuitable for children.
Every application form provided to a prospective renter must include an official statement on unlawful discrimination so applicants are fully aware of their rights.
Strict Data Destruction & Privacy Protections
Data security is a top priority. Victorian guidelines mandate clear timelines for how property managers handle, retain, and destroy applicant documentation:
- Unsuccessful Applicants: To guard against privacy risks, all personal information and submitted documents must be securely destroyed or permanently deleted within 3 months of the property being leased.
- Successful Applicants: Information kept for the duration of the tenancy is managed strictly under Privacy Act guidelines. Once the agreement ends, agents must securely destroy or de-identify the renter's personal records within 3 years.
