COMPETITION TERMS & CONDITIONS
1. Definitions
- 1.1 "Agency" means Barry Plant Emerald.
- 1.2 "Vendor" means the legal owner(s) of the real property listed for sale with the Agency who execute an Eligible Authority during the Promotion Period.
- 1.3 "Eligible Authority" means a fully executed, valid, and legally binding Real Estate Institute of Victoria (REIV) or equivalent Exclusive Sale Authority for residential real property listed with the Agency. It explicitly excludes General Sale Authorities, Auction Authorities (unless specified), or short-term extensions of existing exclusive authorities.
- 1.4 "Promotion Period" means the period commencing at 12:01 AM on 1 September 2026 and concluding at 11:59 PM on 30 November 2026, inclusive.
- 1.5 "Eligible Service" means professional trade, cleaning, gardening, landscaping, or minor property maintenance/repair services engaged to upgrade, fix up, or prepare the listed property for market.
- 1.6 "Property Upgrade Credit" means the maximum benefit of up to $500 (inclusive of GST) payable by the Agency directly toward an approved invoice for an Eligible Service.
2. Eligibility Framework
- 2.1 Listing Timeframe Requirement: To qualify for the $500 Property Upgrade Credit, the Vendor must successfully execute an Eligible Authority with the Agency during the Promotion Period.
- 2.2 Asset Cap: Only one (1) $500 Property Upgrade Credit will be allocated per property asset listed, regardless of the number of individual co-owners or vendors listed on the legal title or Contract of Sale.
- 2.3 Non-Retrospective: This promotion is not retrospective. Any Exclusive Sale Authorities executed prior to 1 September 2026 are strictly ineligible, notwithstanding whether the property is actively marketed or sold during the Promotion Period.
- 2.4 Existing Exclusive Agency Agreements: If another real estate agency holds an active exclusive agency agreement in relation to the property, this offer is void and must be disregarded.
3. Redemption & Invoice Payment Rules
- 3.1 Direct Supplier Payment: The Agency will pay the supplier or trade service provider directly up to the value of $500 (inc. GST) upon receipt of a valid tax invoice made out to or approved by the Agency for Eligible Services conducted on the listed property.
- 3.2 Invoice Excess: If the total supplier invoice exceeds $500, the Agency will contribute a maximum of $500, and the Vendor remains solely responsible for settling any remaining balance directly with the service provider.
- 3.3 No Cash Redemptions or Rebates: The Property Upgrade Credit is non-transferable, non-exchangeable, and cannot be redeemed for cash, taken as a commission discount, or credited back directly to the Vendor.
- 3.4 Approved Suppliers: The Agency reserves the right to approve third-party contractors or suppliers prior to work commencing to ensure the services meet the criteria of an Eligible Service.
4. General Provisions
- 4.1 Variation: To the extent permitted by Australian Consumer Law, the Agency reserves the right to modify, amend, or terminate this promotion at any time. Any such changes will not affect listings where an Eligible Authority was already fully executed while the campaign was active.
- 4.2 Governing Law: These Terms and Conditions are governed by the laws of Victoria, Australia, and any disputes are subject to the exclusive jurisdiction of the courts of Victoria.
